By accessing or using ClaimVia.net ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform. These terms apply to all users including policyholders, claim professionals, and administrators.
ClaimVia.net is a property loss recovery marketplace and workspace platform. It connects property owners who have suffered a property loss with vetted professionals including public adjusters, contractors, engineers, appraisers, and insurance attorneys. ClaimVia.net provides workspaces for managing documents, communications, milestones, and payments throughout the recovery process, but is not a party to any engagement between a policyholder and a professional.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information during registration and to keep it updated. ClaimVia.net reserves the right to suspend or terminate accounts that violate these terms.
Professionals using ClaimVia.net represent that they hold all required licenses and credentials for the services they offer, that they will conduct themselves professionally, and that any information provided on their profile is accurate. ClaimVia.net may remove professionals who violate these standards.
Attorney services offered through ClaimVia.net are advisory in nature and do not constitute legal representation in litigation. Attorneys using ClaimVia.net offer consultations, document reviews, strategy sessions, and limited-scope advisory work. Clients seeking full legal representation should execute a separate engagement agreement directly with the attorney. Fees for advisory services are agreed and handled directly between the client and the attorney under their separate engagement terms.
ClaimVia.net charges professionals and attorneys a fixed membership fee only (monthly or annual, as selected). ClaimVia.net does not charge a percentage platform fee, success fee, referral fee, or any outcome-based payment on engagements, professional service fees, insurance settlements, carrier payments, or claim recovery amounts. Property owners are never charged by ClaimVia.net. Free professional accounts include up to 3 proposal submissions per calendar month; paid membership tiers include unlimited proposals.
Membership subscription fees are billed in advance and are non-refundable except as required by law. ClaimVia.net does not currently act as an escrow agent and does not hold funds in escrow. Any fees, deposits, retainers, invoices, or payment terms between a user and a professional, attorney, contractor, or service provider are handled under their separate agreement.
Users may not use the platform for fraudulent activity, to misrepresent credentials or outcomes, to misuse the platform to circumvent its membership terms, to harass other users, or to violate any applicable laws or regulations.
Disputes between policyholders and professionals should first be addressed through ClaimVia.net's built-in dispute process. ClaimVia.net may facilitate but does not adjudicate disputes. For legal disputes with ClaimVia.net, you agree to binding arbitration under AAA rules in the state of Florida, waiving the right to class action litigation.
ClaimVia.net is not liable for the actions or outcomes of any professional engaged through the platform. ClaimVia.net's total liability to any user shall not exceed the fees paid to ClaimVia.net in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
The platform is provided "as is" without warranties of any kind. ClaimVia.net does not guarantee claim outcomes, professional availability, or the accuracy of any weather, damage, or insurance data provided through the platform. Nothing on ClaimVia.net constitutes legal or insurance advice.
We may modify these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use of the platform after changes constitutes acceptance.
